These Terms and Conditions (this Agreement) govern your access to and use of FreshSuite, the social media marketing platform operated by Through Fresh Eyes, including all related websites, applications, tools, software, and services (collectively, the Service).
Through Fresh Eyes (we, us, our) provides the Service to you (you, Client, Registrant, Member). By accessing or using FreshSuite, whether as a free trial user or a paid subscriber, you agree to be bound by this Agreement. If you do not agree, do not access or use the Service.
This Agreement may be updated from time to time. Any changes become effective when posted. Continued use of the Service constitutes acceptance of the revised terms.

Description of the Service
FreshSuite is a social media marketing and management platform provided by Through Fresh Eyes. Unless explicitly stated otherwise, any new features, tools, integrations, or enhancements added to the Service are subject to this Agreement.

2. Data Collection and Ownership
Client Data and Participant Data
You retain ownership of all content, data, and information you upload, submit, or generate using the Service, including participant or audience data (Client Data).
Aggregate and Anonymized Data
Through Fresh Eyes may collect, use, and analyze aggregated, anonymized, and de-identified data derived from use of the Service for analytics, benchmarking, product improvement, reporting, and performance analysis. This data does not identify individual users or end customers.
Compliance
Each party agrees to comply with all applicable laws, regulations, social media platform policies, and privacy requirements related to the collection and use of data.

3. Authorization to Act on Your Behalf
By connecting social media accounts, business profiles, or third-party services to FreshSuite, you authorize Through Fresh Eyes to access, store credentials or tokens, publish content, retrieve analytics, and perform actions on your behalf solely to provide the Service.
You represent and warrant that you have all necessary rights, permissions, and authority to grant this access.

4. AI-Generated Content
FreshSuite may include AI-assisted tools that generate suggested captions, posts, responses, prompts, or other content. AI-generated outputs are provided for convenience only and may contain inaccuracies, incomplete information, or content that is not suitable for your specific use case.
You are solely responsible for reviewing, editing, approving, and ensuring compliance with all applicable laws, advertising standards, and third-party platform policies before publishing or using any content generated through the Service.
Through Fresh Eyes makes no guarantees regarding the accuracy, originality, legality, or performance of AI-generated content.

5. Beta Features
From time to time, FreshSuite may include features labeled as beta. Beta features may be experimental, incomplete, or unstable. Use of beta features is at your own risk. Through Fresh Eyes makes no warranties regarding beta features and is not responsible for any issues arising from their use.

6. API Services
Access to API functionality, if offered, may be modified, limited, suspended, or terminated at any time. You are responsible for all activity conducted using your API keys or credentials. Do not share your keys.

7. Account Registration and Security
You must provide accurate and complete information when creating an account. Each login may only be used by one person unless your plan explicitly allows otherwise.
You are responsible for maintaining the security of your account credentials. Through Fresh Eyes is not liable for loss or damage resulting from unauthorized account access due to your failure to secure your credentials.

8. Eligibility and Age Requirements
You must be at least 18 years of age to use FreshSuite. The Service is not intended for children under 13. By using the Service, you represent that you have the legal authority to enter into this Agreement.

9. Prohibited Uses
You may not:
modify, hack, or interfere with the Service
reverse engineer or extract source code
transmit malware or harmful code
use automated bots to access the Service
falsely imply association with Through Fresh Eyes
violate applicable laws or third-party platform policies

10. Proprietary Rights
Through Fresh Eyes owns all rights, title, and interest in the Service, including software, branding, and intellectual property. No rights are granted except as expressly stated in this Agreement.

11. Third-Party Platforms and Integrations
FreshSuite integrates with third-party platforms such as social networks and content distribution services. Through Fresh Eyes is not responsible for third-party platform actions, outages, policy changes, account suspensions, content removals, API limitations, or reduced visibility.
Your use of FreshSuite must comply with all applicable third-party terms and policies.

12. Service Availability
Through Fresh Eyes does not guarantee uninterrupted or error-free operation of the Service. Temporary interruptions may occur due to maintenance, updates, system issues, or third-party failures.

13. Data Backup Responsibility
You are solely responsible for maintaining backups of your content and data. Through Fresh Eyes is not responsible for data loss due to suspension, termination, technical issues, or third-party actions.

14. Subscription Plans and Billing
FreshSuite subscriptions are billed monthly in advance unless otherwise stated. Pricing and plan details are available on the Pricing Page and are incorporated into this Agreement.

15. Subscriptions, Payments, and Cancellation
15.1 Payment Method
A valid payment method is required. You authorize recurring charges to your selected payment method.
15.2 Auto-Renewal
Subscriptions automatically renew monthly unless you cancel before your next billing date.
15.3 Refunds
Subscription fees are non-refundable. Because you may cancel at any time prior to your next billing date, no refunds or prorated credits are provided for partial months, except where required by law.
15.4 Cancellation
You must cancel through your account settings. Email requests alone do not constitute cancellation. Cancellation stops future charges but does not refund prior payments.
15.5 Failed Payments and Account Suspension
If a payment is declined, reversed, or disputed, access to the Service may be suspended. Continued non-payment may result in termination. Data associated with suspended or terminated accounts may be permanently deleted after a reasonable period and may not be recoverable.

16. Chargebacks and Collections
Disputed charges may result in suspension until resolved. Past-due balances may accrue interest at the maximum rate permitted by law, and you may be responsible for collection costs.

17. Marketing Use of Campaigns
You grant Through Fresh Eyes permission to feature your campaigns, business name, or logos for marketing and promotional purposes related to FreshSuite. You may opt out by submitting a support request.

18. Disclaimer of Warranties
THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE. THROUGH FRESH EYES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

19. Limitation of Liability
To the maximum extent permitted by law, Through Fresh Eyes will not be liable for indirect, incidental, consequential, or punitive damages. Total liability will not exceed the amount paid by you in the twelve months preceding the claim.

20. Indemnification
You agree to indemnify and hold harmless Through Fresh Eyes from claims arising from your use of the Service, your content, or your violation of this Agreement or third-party rights.

21. Force Majeure
Through Fresh Eyes is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, internet outages, governmental actions, or third-party service disruptions.

22. Feedback
Any feedback or suggestions you provide may be used by Through Fresh Eyes without obligation or compensation.

23. Assignment
You may not assign this Agreement without consent. Through Fresh Eyes may assign this Agreement in connection with a merger, acquisition, or sale of assets.

24. Governing Law
This Agreement is governed by the laws of the State of California. Any disputes will be resolved exclusively in the courts located in Sacramento County, California.

25. Entire Agreement
This Agreement constitutes the entire agreement between you and Through Fresh Eyes regarding FreshSuite and supersedes all prior agreements.
